You rent your Polish flat short-term.
Do you actually have what an inspector asks for?
Do you have a fire safety declaration? An energy performance certificate? Do you know how long you can legally keep guest data? Most owners — especially those living abroad — find out about these obligations only after the first inspection.
Polish fire department and sanitary inspectors come unannounced. Energy performance certificates have been mandatory since 2023, with monthly fines between 20 and 5,000 PLN for non-compliance.
On top of that, from 20 May 2026, EU Regulation 2024/1028 introduces a new obligation: registration in CWTON (Centralny Wykaz Turystycznych Obiektów Noclegowych — Poland's Central Register of Tourist Accommodation). The Polish implementing law (UC135) is still in draft, but the registry is preparing to launch — owners with documents ready upfront will skip the queue.
What's at risk
- Fire department / sanitary inspection — fine, order to remove violations, in extreme cases ban on operating
- Energy performance certificate — 20–5,000 PLN fine, enforced since 2023 by the Polish building inspectorate
- GDPR — administrative fine up to 4% of turnover (Polish UODO authority); typically a few thousand PLN for small hosts
- CWTON (when live) — up to 50,000 PLN fine, up to 10,000 PLN for incorrect data, listing hidden on Airbnb / Booking after the transition period

Smoke detector and fire extinguisher are required, not recommended
Polish fire safety law requires smoke detectors and a fire extinguisher. At property registration or inspection you sign a declaration under criminal liability (Art. 233 §6 Polish Penal Code) that your property meets these requirements. No detector = real criminal risk, not just a fine.
Energy performance certificate, mandatory for STR since 2023
Every rental, including short-term, requires an energy performance certificate (świadectwo charakterystyki energetycznej). Fine: 20 to 5,000 PLN, enforced by the Polish building inspectorate (PINB). Cost to obtain: 150 to 400 PLN through a certified surveyor. The HostReady package walks you through how to get one without setting foot in Poland.
Guest registry is GDPR-regulated
Collecting guest personal data? You need a legal basis, an information clause, and a clearly defined data retention period. The Polish data protection authority (UODO) actively enforces this, and yes, this applies to foreign owners with Polish properties.
Inspection without notice
Polish fire department and sanitary inspectors can visit without warning. Documents have to be ready at any time, not just after a phone call. If you're abroad, your property manager has to have access to the full file.
The certificate doesn't replace the chimney inspection
Gas installation, chimneys, ventilation, periodic inspections required, documentation has to be on hand for every check.
CWTON registry coming in 2026, be ready
EU Regulation 2024/1028 introduces a mandatory registry (CWTON) from 20 May 2026. The Polish implementing law (UC135) will set the details, the current draft includes a transition period until 1 October 2026 and fines up to 50,000 PLN.
