The relevant legal framework has two components:

  • Real Decreto 933/2021: requires you to collect specific guest identity data and submit it to the police within 24 hours. This must happen regardless of whether check-in is attended or self-service. The law does not specify the method of collecting data, only that it must be collected.
  • Ley de Propiedad Horizontal (LPH) Article 17.12: allows a comunidad de propietarios to regulate or restrict tourist use of apartments in a building. Some communities have passed resolutions requiring the presence of a responsible person during check-in.   • The physical key can be copied by a guest, creating a security risk for subsequent guests.
